Murphys Plumbing and Gas - Terms & Conditions of Trade
Effective Date: 27/05/2026

 

These Terms & Conditions apply to all work completed by Murphys Plumbing and Gas ("we", "us", "our") and the client
("you", "your"). By accepting a quote, booking work, approving work to proceed, or allowing work to commence, you
agree to these terms.

 

1. Quotes, Estimates & Acceptance
Written quotes are valid for 30 days from the date issued unless otherwise stated. Estimates are provided as a guide
only and may vary depending on site conditions, hidden defects, investigation findings, materials, access, or changes to
scope.
A fixed quote applies only where clearly stated in writing. Acceptance of a quote, booking, or commencement of work
constitutes acceptance of these Terms & Conditions. Any requested changes to agreed works may result in additional
charges.

 

2. Pricing, GST & Pricing Schedule
Unless clearly stated otherwise, prices are exclusive of GST. GST will be added where applicable.
Murphys Plumbing and Gas may update its pricing schedule from time to time. The applicable pricing will be the pricing
current at the time the work is booked or carried out, unless otherwise agreed in writing.
Different rates may apply depending on the nature of the work, including plumbing, drainage, gasfitting, maintenance,
investigation, compliance work, after-hours work, urgent callouts, weekend work, and public holiday work.

 

3. Minimum Charge, First Hour & Billing Increments
A minimum charge may apply to each job or site visit. Where a first-hour charge applies, this includes the first hour or
part thereof.
Time after the first hour may be charged in 15-minute increments. Reasonable job-related time may be charged,
including setup, pack-down, supplier visits, sourcing or collecting materials, returning or exchanging materials,
compliance documentation, and other offsite work reasonably required to complete the job.

 

4. Callouts, Site Service Fee & Travel
Where a first-hour charge applies, the site service fee for travel, vehicle, and job setup costs within New Plymouth is
built into the first-hour price and is not charged as a separate additional fee.
Travel beyond a 15 km radius of New Plymouth CBD may be charged at $1.50 + GST per kilometre each way, unless
otherwise agreed in writing.
Parking, access costs, and other reasonable site-specific costs may be charged where applicable.

 

5. After-Hours, Weekend & Public Holiday Work
After-hours work means work carried out after 5:00pm and before 7:30am Monday to Friday, and
any work carried out on a Saturday or Sunday.
After-hours, weekend, urgent, and public holiday work may incur additional callout fees, higher hourly rates, minimum
charges, or surcharges. These charges will be advised where practical before work begins.
Public holiday work may be charged at a higher rate or include a public holiday surcharge in accordance with the
current pricing schedule.

 

6. Variations & Additional Work
Any work outside the quoted or agreed scope, including unforeseen repairs, additional labour, additional materials,
compliance requirements, rework caused by others, client-requested changes, additional travel, or extra
documentation, may be charged in addition to the original quote.
Where practical, approval will be sought before proceeding with additional work. However, urgent or necessary work
may sometimes be required to make a site safe, protect property, comply with legal requirements, or prevent further
damage.

 

7. Investigation, Fault Finding & Return Visits
Time spent investigating, diagnosing, testing, locating faults, exposing work, or confirming the cause of an issue is
chargeable, whether or not the issue is able to be repaired during the same visit.
Additional visits required due to unavailable materials, client delays, access issues, further investigation, inspections,
staged work, or matters outside Murphys Plumbing and Gas control may be charged separately.

 

8. Payment Terms
Payment is due upon completion of work unless otherwise agreed in writing. For larger projects, progress payments
may be required and will be outlined before work begins.
Where applicable, invoices may be issued as payment claims under the Construction Contracts Act 2002.
Overdue invoices may incur interest at 2.5% per month, plus any debt collection, legal, or
recovery costs reasonably incurred.
Any disputed amount should be raised promptly. Undisputed amounts remain payable by the due date.

 

9. Deposits
Deposits may be required before work is booked, materials are ordered, or larger jobs commence.
Deposits are refundable where work does not proceed, less any reasonable costs already incurred, including restocking
fees, administration, supplier charges, deposits paid to suppliers, or materials purchased specifically for the job.

 

10. Materials, Supply Delays & Client-Supplied Materials
We are not liable for delays caused by supplier shortages, backorders, weather events, access issues, emergencies, or
circumstances beyond our control. Equivalent materials may be substituted where necessary, subject to suitability and
compliance.
Where the client supplies materials, fittings, appliances, or fixtures, Murphys Plumbing and Gas is not responsible for
product defects, missing parts, suitability, delays, warranty issues, or compliance issues relating to those supplied
items. Additional labour or return visits caused by client-supplied materials may be charged.

 

11. Access, Site Conditions & Hazardous Materials
You agree to provide safe and reasonable access to the work area. Additional charges may apply where access is
restricted, unsafe, delayed, or significantly different from what was disclosed.
We are not responsible for delays, damage, or additional work arising from undisclosed services, obstructions, unsafe
conditions, hidden defects, or site conditions outside our control.
If asbestos, contaminated material, unsafe services, or other hazardous conditions are discovered, work may be
paused until the issue is made safe. Any resulting delay, testing, specialist removal, or additional work may be charged
separately.

 

12. Existing Systems & Hidden Defects
Plumbing, drainage, gasfitting, and associated systems may contain hidden faults, poor installation, aged components,
or non-compliant work not visible during quoting or initial inspection.
If additional defects are discovered, further work may be required and charged accordingly.

 

13. Drainage & Blockages
Drain clearing work does not guarantee that a drain will not block again. Repeat blockages may occur due to pipe
defects, tree roots, collapsed drains, incorrect installation, foreign objects, ground movement, poor maintenance, or
other underlying issues.
Further investigation, CCTV inspection, repair, or replacement may be recommended and charged separately.

 

14. Compliance, Certification & Documentation
All work will be completed in accordance with applicable New Zealand standards, legislation, council requirements, and
licensing obligations where required.
Compliance certificates, gas safety certificates, certificates of compliance, records of work, as-builts, reports, producer
statements, and other documentation may be charged separately unless included in a written quote.
Any certificate, record, or compliance document supplied by Murphys Plumbing and Gas applies only to the work
completed by Murphys Plumbing and Gas and does not certify existing installations, other trades work, hidden defects,
or work outside the agreed scope.

 

15. Warranty
We provide a 12-month workmanship warranty on labour performed by Murphys Plumbing and Gas from the date of
completion. This warranty covers defects arising directly from our workmanship.

 

The warranty does not cover:

:manufacturer defects, which are covered by supplier or manufacturer warranties
:fair wear and tear
:blockages caused by misuse, foreign objects, tree roots, defective pipework, or underlying drainage issues
:damage caused by third parties, weather events, movement, poor maintenance, pre-existing issues, or hidden
defects
:client-supplied materials, fittings, appliances, or fixtures
:alterations or repairs performed by others after our work is completed

 

Any warranty claim must be reported within the warranty period and we must be given a reasonable opportunity to
inspect and remedy the issue.

 

16. Ownership & Risk
Materials supplied remain the property of Murphys Plumbing and Gas until paid in full. Risk in goods passes to the client
upon installation or delivery.
Where legally permitted, Murphys Plumbing and Gas may recover unpaid goods or materials that have not become
permanently fixed or where removal would not cause damage.

17. Photos & Records
Murphys Plumbing and Gas may take photos, videos, notes, measurements, or other records of work completed for
quality assurance, compliance, insurance, dispute resolution, and internal business records.
Client-identifying information will not be used for marketing without permission.

 

18. Cancellations & Delays
If work is cancelled after materials have been purchased, labour allocated, or preparation completed, costs already
incurred may be charged.
We reserve the right to reschedule work due to weather, illness, emergencies, material delays, unsafe conditions,
access issues, or unforeseen circumstances.

 

19. Liability
To the maximum extent permitted by law, our liability is limited to rectifying defective workmanship.
We are not liable for indirect, consequential, or unforeseen losses including business interruption, property damage
caused by existing faults, loss of use, delays outside our control, or issues outside the agreed scope.

 

20. Consumer Guarantees Act
Nothing in these terms limits your rights under the New Zealand Consumer Guarantees Act 1993 where applicable.
Where services are supplied for business purposes, the parties agree that the Consumer Guarantees Act may not apply
to the extent permitted by law.

 

21. Disputes
Any concerns regarding work completed must be raised promptly to allow a reasonable opportunity for resolution.
Both parties agree to attempt to resolve disputes in good faith before formal legal action.
Murphys Plumbing and Gas: By accepting a quote, booking work, approving work to proceed, or
allowing work to commence, you acknowledge and accept these Terms & Conditions
